{"id":4792,"date":"2019-06-18T09:53:53","date_gmt":"2019-06-18T07:53:53","guid":{"rendered":"http:\/\/blog.donpiso.com\/?p=4792"},"modified":"2022-02-24T22:02:56","modified_gmt":"2022-02-24T21:02:56","slug":"entrada-vigor-la-nueva-ley-hipotecaria","status":"publish","type":"post","link":"https:\/\/blog.donpiso.com\/entrada-vigor-la-nueva-ley-hipotecaria\/","title":{"rendered":"Entrada en vigor de la nueva ley hipotecaria"},"content":{"rendered":"<p>Ayer lunes supuso el primer d\u00eda h\u00e1bil que entr\u00f3 en vigor la nueva ley del cr\u00e9dito inmobiliario, que fuera aprobada por el Congreso de los Diputados como la Ley Reguladora de los Contratos del Cr\u00e9dito Inmobiliario. \u00a0Esta reforma introduce novedades como, por ejemplo, la obligaci\u00f3n por parte de la banca de remitir toda la informaci\u00f3n del contrato al notario con la intenci\u00f3n de que asesore al cliente 10 d\u00edas antes de la firma del cr\u00e9dito. Otra de las novedades m\u00e1s destacadas es la regulaci\u00f3n sobre quien se har\u00e1 cargo de las primeras copias de notario, gastos de registro y de gestor\u00eda, que pasan de los clientes a ser responsabilidad de los bancos. Esto supondr\u00e1 un ahorro para el cliente ya que ahora solo deber\u00e1 afrontar las segundas copias del notario y los gastos de tasaci\u00f3n.<\/p>\n<p>Entre las novedades destacadas\u00a0de la Ley Reguladora de los Contratos del Cr\u00e9dito Inmobiliario es que esta tambi\u00e9n establece que la hipoteca para la primera vivienda quedar\u00e1 gravada con el impuesto de actos jur\u00eddicos documentados (AJD) que pagar\u00e1n las entidades financieras y tambi\u00e9n la eliminaci\u00f3n de las cl\u00e1usulas suelo. Adem\u00e1s, ahora el banco solo podr\u00eda iniciar el procedimiento de desahucio si se acumulan 12 cuotas de impago o el 3% del capital de la hipoteca en la primera mitad de vida del pr\u00e9stamo; o bien de 15 cuotas o el 7% en la segunda mitad de este.<\/p>\n<p>A partir de ahora el cliente podr\u00e1 contratar con otra entidad diferente a la que concede el pr\u00e9stamo, los seguros o las p\u00f3lizas de hogar siempre que cumpla los requisitos del contrato. De esta forma el prestamista no podr\u00e1 cobrar comisi\u00f3n o ning\u00fan gasto por el an\u00e1lisis de estas p\u00f3lizas. En otras palabras, se proh\u00edbe la venta obligada de productos vinculados a la hipoteca. De esta forma la nueva Ley pretende que todas las cl\u00e1usulas abusivas pasen a estar controladas por norma imperativa, para crear una mayor seguridad de los consumidores frente a los
